On 26 May FCT obtained a formal opinion from the Direção-Geral da Administração e do Emprego Público (DGAEP) according to which the pay cuts set in the 2014 State Budget Law (article 33) is not applicable to studentship and fellowship contracts. This opinion, signed by the Secretary of State for Public Administration, derives from the fact that the studentship and fellowship contracts do not include any financial component directed at paying for work carried out or at the exercising of any other functions. Thus, they are not covered by the article in question of the State Budget Law.
The FCT Board has informed research institutions of these latest developments, which underscore FCT’s own legal opinion and its position since the matter first emerged. FCT has not taken any action to legitimise the application of pay cuts to graduate students and fellows. All notices and clarifications that FCT has made on this subject have been directed at work contracts or other service contracts, and may not be extrapolated to studentship and fellowship contracts.
