RGPDI – Law No. 93/2021 of December 20

The FCT created this page with the following objectives:

  • Ensure the protection of whistleblowers who report violations in good faith, prohibiting acts of retaliation/threats;
  • Enable internal reporting of acts harmful to the public interest/infractions in the areas provided for in Law No. 93/2021;
  • Rapid and effective elimination of risks to the public interest that the reported act may cause or is causing.

This is the right place to file your complaint in the following situations:

  • If you wish to file a formal complaint about an offense that has been committed, is being committed, or can reasonably be expected to be committed by a body that forms part of the internal structure of the FCTor within the scope of the professional activity that it carries out/provides.

Professional relationship for these purposes (namely in the capacity of):

  1. Workers;
  2. Service providers, contractors, subcontractors, and suppliers, as well as any persons acting under their supervision and direction;
  3. Individuals belonging to administrative or management bodies or to fiscal or supervisory bodies of the FCT, including non-executive members;
  4. Volunteers and interns, paid or unpaid;
  5. Any individual who is party to the complaint procedure is also considered to be a stakeholder directly or indirectly related to the complaint, regardless of:
    1. Professional activity, nature of this activity, and the sector in which it is carried out;
    2. From the professional relationship, however, if it has been terminated.
  6. If the violation relates to one of the following areas mentioned in Article 2 of the aforementioned Law No. 93/2021.

Areas that may be covered by the complaint

    1. Act or omission contrary to the rules laid down in the acts of the European Union referred to in the Annex to Directive (EU) 2019/1937:
      1. Public Procurement;
      2. Financial services, products, and markets, and prevention of money laundering and terrorist financing;
      3. Product safety and compliance;
      4. Transport safety;
      5. Environmental protection;
      6. Radiation protection and nuclear safety;
      7. Food safety for human and animal consumption, animal health, and animal welfare;
      8. Public health;
      9. Consumer protection;
      10. Protection of privacy and personal data, and security of the network and information systems;
    2. Any act or omission contrary to and detrimental to the financial interests of the European Union referred to in Article 325 of the Treaty on the Functioning of the European Union (TFEU) (fraud and any other illegal activities detrimental to the financial interests of the Union);
    3. Act or omission contrary to the rules of the internal market referred to in Article 26(2) TFEU, including the rules on competition and State aid. (The internal market comprises an area without internal frontiers in which the free movement of goods, persons, services, and capital is ensured in accordance with the provisions of the Treaties).
    4. Violent crime, especially violent and highly organized crime, as well as the crimes provided for in Article 1(1) of Law No. 5/2022 of January 11, namely:
      1. Trafficking in influence;
      2. Improper receipt of benefits;
      3. Active and passive corruption, including that practiced in the public and private sectors and in international trade, as well as in sports;
      4. Embezzlement;
      5. Economic participation in business;
      6. Money laundering;
      7. Criminal association;
      8. Any act or omission that contravenes the purpose of the rules or standards covered by subparagraphs a) to c).

By submitting a complaint, you declare that you are aware of the rules in force.
If the complaint does not meet the requirements for processing, FCT, I.P. reserves the right to dismiss it outright.
