INPI launches public consultation on Standards Essential Patents
The National Institute of Industrial Property (INPI) has launched a public consultation on the new Proposal for a Regulation of the European Parliament and of the Council on Standard Essential Patents (SEPs) and amending Regulation (EU) 2017/1001.
This proposal aims to create an efficient and sustainable framework with the continued participation of innovators in standardization, as well as access for companies to standardized technology.
SPEs are patents that protect technologies incorporated into a standard and are "essential" to its implementation. This Regulation applies to patents that are essential to a standard published by a standardization body, in relation to which the SEP holder has committed to license its SEPs on fair, reasonable, and non-discriminatory terms and which is not subject to a royalty-free intellectual property policy after the entry into force of this Regulation.
