Books - Versions and Licenses

It depends on the applicable way to implement FCT's open access policy.
If the book, book chapter or monograph is published on an open access website or platform (golden route), the version published in open access on the website or platform must be the final version of the article (Version of Record). This version must also be deposited in a repository.
If the book, book chapter or monograph is published in closed access (green), the version deposited in a repository must be theAuthor's Accepted Manuscript, unless the publisher allows the Version of Record to be deposited.

The Author's Accepted Man uscript or Accepted Manuscript is the version of the book, book chapter or monograph generated by the author, which includes changes resulting frompeer review, before being edited and formatted by the publisher.

A Version of Record (VoR) is the final version of the book, book chapter or monograph, as published, after it has been edited and formatted by the publisher.

Retention of rights means that copyright is not transferred to the publisher. These are retained by the author, who can then continue to exercise them and can allow his work to be reused by third parties, in particular by allowing it to be copied, distributed, adapted, as well as complementary work made on the basis of his work.

Implementing the rights retention strategy involves notifying the publisher that an open public license (usually a Creative Commons license) is applied to the submitted manuscript and will be applied to all subsequent versions until the manuscript is accepted for publication after peer review.
This notification must be made in the following terms:
- Book, book chapter or manuscript published on the publisher's open access website or platform, i.e. published immediately in open access:

Although not desirable, the availability of books, monographs and book chapters may be subject to an embargo period of up to 12 months if they are not immediately published in open access by the publisher.
The embargo period allowed is primarily intended to allow publishers to generate revenue that will allow them to sustain their activity. The book publishing market is different from that of periodicals, being more atomized and generating smaller revenues. On the other hand, the costs of publishing books are higher than for articles and publishers depend on the revenue generated by the sale of single books. Finally, book publishers are not guaranteed permanent income from journal subscriptions or APC payments.

A Creative Commons license is a license based on an alternative model to traditional copyright, giving the author the possibility to define how he wants his work to be used by third parties and, therefore, which rights reserved for him by the traditional copyright regime are allowed to be exercised by third parties.
There are several types of Creative Commons license(About CC Licenses - Creative Commons), and the one indicated in FCT's Open Access Policy states that, as a rule, the author must associate a CC-BY, CC-BY-NC, CC-BY-ND or CC-BY-NC-ND license with their article.
An equivalent license may also be applied to the work, provided it is authorized by the FCT.

By applying a Creative Commons license to the AAM version of their book, book chapter or monograph, the author is creating the conditions for it to be accessible and reusable by anyone who has an interest in it, thus fulfilling the purpose of making content resulting from FCT funding open access. In this way, the author is retaining their copyright or, in other words, they are not transferring it to the publisher. In this way, the author makes it possible for the AAM version of his article to be used freely, not only by himself, for example by depositing it in a repository, but also by third parties. The extent to which the work can be reused depends on the type of license applied. In all cases, due credit must be given to the author.

The procedure for validating the application of an equivalent license involves submitting a request to FCT for the application of a different license. The request must be addressed to politica-publicacoes@fct.pt and identify the publication in question, the alternative license to be applied and the justification for its use. The request will be analyzed and a decision made, taking into account the context of the situation under analysis and the possible convenience or necessity of applying a license other than those mentioned.
