It is important to distinguish between two situations which correspond to two different ways of complying with FCT's open access policy:
If the author obtained the academic degree at a Portuguese institution, it must, in accordance with the provisions of Decree-Law no. 115/2013, of August 7, deposit the thesis or dissertation in a repository of the RCAAP network, within 60 days of the award of the degree, thus ensuring compliance with the policy.
If the author obtained their degree at a foreign institution, they must deposit their thesis or dissertation in a RCAAP network repository within 60 days of obtaining the degree.

Because Decree-Law no. 115/2013, of August 7, which imposes on degree-granting institutions the obligation to deposit the thesis or dissertation, only does not apply to institutions not subject to the national legal order, and therefore that obligation cannot be extended to foreign institutions that do not award degrees in Portugal.

No. Doctoral theses and master's dissertations that result from total or partial FCT funding must be published in open access.

Yes, the open access policy applies to theses and dissertations that have received total or partial funding from the FCT.

The Policy is aimed at publications resulting from FCT funding. Authors of publications that do not fall within this scope are not obliged to comply.
